12-Hour Education Rule
You cannot schedule a sales/marketing event within 12 hours of an educational event at the same location.
48-Hour Scope of Appointment Rule
You must obtain a valid Scope of Appointment at least 48 hours prior to a scheduled marketing/sales appointment.
Exception: if the beneficiary is a walk-in, an inbound call, or they are within 4 days from the end of a valid election period.
So if you’re scheduling the meeting ahead of time, the 48-hour rule applies. If the beneficiary contacts you directly or walks into your office/location, the rule doesn’t apply.
Either way, you always must capture the SOA prior to enrollment.
Maintenance of SOAs
- Completed SOAs must be retained for 10 years. If you use Simply Enroll or a carrier’s e-app, this is done for you automatically.
- SOAs are valid for up to 12 months following the date of the beneficiary’s signature.
- If the SOA is completed verbally on the inbound call, it must be recorded (Simply Enroll also helps with this).
Respecting Permission to Contact
- You can’t require someone to share their age/birthday/health status as a prerequisite for talking to you in a lead form/BRC.
- You must ensure that the prospect is clearly informed that by sharing their information with you, they will be contacted by a licensed insurance agent.
- BRCs and PTCs (business reply cards and permission to contact) expire after 12 months.
- You must give people the ability to opt-out/unsubscribe from email communications.
- No door-to-door solicitations with a BRC
Service Area Accuracy
Do not market benefits in a service area where those benefits are not actually available.
